AJI ("we," "us," "our") respects your right to privacy and recognizes the importance of protecting your personal data ("Data").
We have adopted this Privacy Policy ("Policy") to explain how we collect, process, store, transfer, and protect the Data you provide to us or that we collect when you use our website ("Website"), complete our questionnaires ("Questionnaires"), subscribe to and use our application ("App"), and our services involving task organization with the help of an AI assistant ("Services"), or any other features operated by AJI.
Depending on the context in which you provide your Data, we may act as a data controller, joint controller, or data processor under this Policy. This Policy applies when we act as a data controller in relation to your Data.
We reserve the right to amend this Policy at any time and at our sole discretion. In the event of any changes, we will post updates, depending on the platform, on the homepage of the Website and/or on the App’s home screen to keep you fully informed. Any changes to the Policy will take effect thirty (30) days after publication. Your continued use of our Services will signify your acceptance of the updated Policy.
This Policy is connected to the Terms of Use, and all capitalized terms used herein have the meaning defined in those Terms, which are available for review.

II. PERMISSIBLE AGE AND CHILDREN'S PRIVACY
THE APP IS NOT INTENDED FOR USE BY INDIVIDUALS UNDER THE AGE OF 13. WE DO NOT KNOWINGLY COLLECT PERSONAL INFORMATION FROM CHILDREN UNDER 13. IF YOU ARE UNDER 13, PLEASE DO NOT USE THE APP OR PROVIDE ANY INFORMATION TO US.
We are committed to protecting children’s privacy. Our Website, App, and Services are not intended for children under 13, and we do not knowingly collect information from users under 13 in accordance with the Children’s Online Privacy Protection Act (COPPA).
Users aged 13 to 18 may use the App only with the consent and supervision of a parent or legal guardian who agrees to the terms of this Policy. We require all users to confirm upon subscribing to our Services that they are 18 years old or older, or, if not, that they have obtained parental consent.
For users under 18, we may limit how we collect, use, and store their Data, which may mean they will not have access to certain features.

Data we collect automatically when you use the Services:

  • information about your progress, energy levels, how tasks affect your condition, and reflections at the end of the day;
  • device and connection information, including your IP address, device, operating system, browser type, and device metrics;
  • information provided about you by others, including landing page data, app usage, and AI assistant interactions.
IV. FOR WHAT PURPOSES DO WE USE YOUR DATA?
We process your Data to provide you with access to and use of the Services, enhance your user experience, and, in certain cases, to comply with legal obligations, including:
  • managing your account, especially when you personalize your profile and settings;
  • managing your use of the Services, helping you overcome procrastination, improve your psychological, physical, and mental state, understand your priorities, achieve your goals, structure your tasks to make them more achievable, and manage your energy levels;
  • improving the Services by optimizing the usability and effectiveness of their features;
  • providing user support by responding to your inquiries and complaints;
  • communicating with you regarding your use of the Services and any other questions or clarifications you may have;
  • promoting our other Services and those of our Partners by sending you information about other or upcoming offerings that may be of interest to you;
  • preventing and detecting any fraud or, more generally, illegal activity to protect you and, when necessary, participating in investigations and procedures conducted by public authorities or government agencies;

V. DO WE USE COOKIES OR SIMILAR TECHNOLOGIES TO COLLECT YOUR DATA?
Cookies are small text files that are automatically created by your browser and stored on your device when you connect to our Services. We use cookies and similar technologies for the following purposes:
  • to identify you when accessing the Services and to ensure the security of your usage;
  • to improve your user experience by saving your settings and preferences and analyzing how you use the Services;
  • to promote any of our Services or those of our Partners that may interest you;
  • to track any fraudulent or illegal activities.

VI. HOW DO WE STORE YOUR DATA?
We store your Data in servers located in the United States for a duration not exceeding the time necessary for the purposes for which it was collected and processed and always in accordance with legal requirements.
Your Data will remain in our active database for 1 year necessary to provide the Services and will be permanently deleted or anonymized by us or archived in a restricted-access intermediate database after you stop using the Services. However, your contact data will be retained for 3 years to send you promotional messages about our Services.
Data may also be archived for longer periods if we are legally required to retain it—for instance, for compliance, evidence, or tax/accounting purposes. In such cases, retention duration will depend on the relevant legal obligations.


VII. DO WE TRANSFER YOUR DATA OUTSIDE THE U.S.?
Some of our service providers and staff are located outside the U.S. or have offices in countries with different data protection laws. Our company is registered as an LLP in the Republic of Kazakhstan, which means your data may be processed in that jurisdiction. When transferring user Data to our service providers, we ensure that proper legal mechanisms are in place for lawful transfer.


VIII. HOW DO WE PROTECT YOUR DATA?
We are committed to safeguarding your Data and have implemented industry-standard security measures to protect it and restrict access.
Specifically, we have implemented technical and organizational measures to minimize risks of data loss, misuse, unauthorized access or disclosure, including encryption (such as SSL), physical data center access controls, and authorization controls.
For sensitive health and mental data, we use additional measures, including:

  • Anonymization for analytical purposes;
  • Pseudonymization to reduce risk in the event of unauthorized access.
HOWEVER, DESPITE OUR EFFORTS, WE CANNOT GUARANTEE THAT (I) THE SERVICE WILL MEET YOUR EXPECTATIONS, (II) IT WILL BE UNINTERRUPTED, TIMELY, OR ERROR-FREE, (III) RESULTS WILL BE ACCURATE OR RELIABLE, OR (IV) ANY PRODUCTS, SERVICES, OR INFORMATION OBTAINED THROUGH THE SERVICE WILL BE SATISFACTORY.
We cannot ensure absolute security during Internet transmission and recommend taking your own precautions when online.


IX. WHAT ARE YOUR DATA RIGHTS?
You have the following rights regarding your Data:
  • Access your Data (unless otherwise restricted by law);
  • Correct or update your Data via account settings or by contacting us;
  • Delete your Data (except where retention is required by law);
  • Restrict processing in specific situations (e.g., legal claims, objections);
  • Request data portability where technically feasible;
  • Object to processing based on your situation or withdraw consent at any time.
To withdraw consent, contact us at magic@aji.top. Withdrawal does not affect prior lawful processing. After withdrawal, we will cease processing unless otherwise permitted by law.
You can also file a complaint with a supervisory authority: the FTC or your state Attorney General (in the U.S.), or the Ministry of Digital Development in Kazakhstan.

X. WHO DO WE SHARE YOUR DATA WITH?
We share your Data with internal teams (e.g., IT, development, marketing) to provide and enhance the Services.
We also share with third parties acting on our behalf (e.g., payment processors, marketing partners, fraud prevention providers), ensuring they comply with this Policy and relevant data laws.
Additionally, we may disclose Data to competent authorities if legally required. Unless otherwise mandated by law, you will not be notified in such cases.
YOU HEREBY RELEASE US, OUR OFFICERS, EMPLOYEES, AGENTS, AND SUCCESSORS FROM ANY AND ALL CLAIMS RELATED TO THIRD-PARTY INTERACTIONS OR ADVERTISEMENTS.


XI. THIRD-PARTY LINKS
Our Services may contain third-party links or content. You may provide your Data to them at your own risk, and we are not responsible for how they process it. Always read the privacy policy of any third-party website or app you access.
We may rely on third-party advertisers (e.g., Facebook, Google). They may use cookies or tracking tech to show interest-based ads. We do not share your in-app content with them and have no control over their tracking.


XII. PAYMENTS & REFUNDS
Payment Methods and Processing: Payments in the U.S. are processed via secure gateways like Stripe or PayPal in USD. You may pay by card, Apple Pay, Google Pay, etc. Sales tax may apply based on local laws.
Auto-renewal: If not canceled, your subscription may auto-renew. Terms are disclosed in-app.
Trial Subscriptions: Trial periods may convert into paid subscriptions unless canceled in time.
Refund Policy: App Store/Google Play purchases follow their refund policies. Website purchases are non-refundable unless otherwise stated or legally required.
BY AGREEING TO RECEIVE DIGITAL CONTENT IMMEDIATELY, YOU WAIVE YOUR RIGHT TO WITHDRAW. Refunds only apply for faulty digital services and only partially.


XIII. INTERNATIONAL DATA LAW COMPLIANCE
GDPR (EU): If you're in the EEA, GDPR applies. You have:
  • The right to lodge a complaint;
  • The right to know the legal basis for processing;
  • The right to data portability;
  • The right to object to automated decisions.

UNDER NO CIRCUMSTANCES SHALL WE OR OUR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES ARISING FROM YOUR USE OF THE SERVICE OR THIRD-PARTY ADS, EVEN IF ADVISED OF THE POSSIBILITY.
ACCESS AND USE ARE AT YOUR OWN RISK. WE ARE NOT RESPONSIBLE FOR SYSTEM DAMAGE OR DATA LOSS.
OUR TOTAL LIABILITY SHALL NOT EXCEED AMOUNTS PAID BY YOU TO US.

XV. INDEMNIFICATION
You agree to indemnify and hold us, our affiliates, and representatives harmless from any claims arising from your use of the Service, content you provide, or violations of the Terms. We may assume exclusive defense and control of any matter subject to indemnification.


XVI. ARBITRATION AND CLASS ACTION WAIVER
BINDING ARBITRATION. YOU AND THE COMPANY AGREE TO RESOLVE ALL DISPUTES AND CLAIMS RELATING TO THIS POLICY OR USE OF THE SERVICE BY BINDING ARBITRATION RATHER THAN IN COURT, EXCEPT THAT YOU MAY RESOLVE DISPUTES IN SMALL CLAIMS COURT IF YOU HAVE STANDING TO PURSUE SUCH CLAIMS.
CLASS ACTION WAIVER. YOU AND THE COMPANY AGREE THAT EACH PARTY MAY SUE THE OTHER PARTY ONLY INDIVIDUALLY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, REPRESENTATIVE OR CONSOLIDATED LITIGATION. IF THIS PROVISION IS HELD INVALID OR UNENFORCEABLE FOR ANY REASON WITH RESPECT TO ANY CLAIM, THE ENTIRE ARBITRATION SECTION WILL BE VOID WITH RESPECT TO SUCH CLAIM.
WAIVER OF CLAIMS. YOU MAY OPT OUT OF THE ARBITRATION AND CLASS ACTION WAIVER PROVISIONS SET FORTH IN THIS SECTION BY NOTIFYING THE COMPANY BY EMAILING MAGIC@AJI.TOP WITHIN 30 DAYS OF FIRST ACCEPTING THESE TERMS AND CONDITIONS (UNLESS A LONGER PERIOD IS REQUIRED BY APPLICABLE LAW). THE NOTICE MUST INCLUDE YOUR NAME, EMAIL ADDRESS AND A CLEAR STATEMENT THAT YOU ARE OPTING OUT OF THE ARBITRATION PROVISIONS.

XVII. GOVERNING LAW AND JURISDICTION
THIS POLICY IS GOVERNED BY THE LAWS OF THE REPUBLIC OF KAZAKHSTAN WITHOUT REGARD TO CONFLICT OF LAWS PRINCIPLES.
IF YOU ARE A RESIDENT OF THE U.S., THIS POLICY IS ALSO GOVERNED BY THE FEDERAL LAWS OF THE U.S. AND THE LAWS OF THE STATE IN WHICH YOU RESIDE, TO THE EXTENT THEY APPLY TO AGREEMENTS ENTERED INTO AND PERFORMED IN THE U.S. ANY DISPUTES ARISING OUT OF OR RELATING TO THIS POLICY ARE SUBJECT TO SECTION XVI, "ARBITRATION". ANY DISPUTE ARISING OUT OF OR RELATED TO THIS POLICY SHALL BE SUBJECT TO SECTION XVI, "ARBITRATION".
ANY DISPUTES ARISING OUT OF OR RELATED TO THIS POLICY SHALL BE RESOLVED IN ACCORDANCE WITH SECTION XVI, "ARBITRATION AND CLASS ACTION WAIVERS". IF SECTION XVI IS FOUND TO BE INVALID OR INAPPLICABLE, DISPUTES WILL BE BROUGHT BEFORE THE COMPETENT COURT OF THE REPUBLIC OF KAZAKHSTAN WHERE THE COMPANY IS LOCATED.

XIX. FINAL PROVISIONS
If any provision of this Policy is held invalid or unenforceable, such provision shall be modified and construed so as to best achieve the intent of the original provision as a matter of law, and the remaining provisions of the Policy shall remain in full force and effect.
Failure or delay by the Company in exercising any right or remedy under this Policy shall not constitute a waiver of such right or remedy.
This Policy constitutes the entire agreement between you and the Company with respect to the subject matter of the Policy and supersedes all prior agreements, proposals and representations with respect thereto.
